Terms and Conditions

1. General

These terms and conditions apply to public courses, workshops and webinars (hereinafter referred to as "training") of Magic Agile Pty Ltd, Level 1/41-43 Stewart St, Richmond VIC 3121 (hereinafter referred to as "Magic Agile"). Any provisions of the customer that deviate from these conditions shall not apply, even if they are not contradicted by Magic Agile.

2. Services

The following services are included in the prices for public training:

  • Provision of physical or virtual training room and materials for the duration of the training
  • Documents according to availability in English language
  • Delivery of the training contents according to the training description
  • Certification fees, if the training is listed as certified
  • Online coaching after the training, if listed in the training description
  • Drinks, snacks and lunch for full-day in-person events

Additional costs, such as travel and accommodation costs, are not included in the prices for public training.

3. Registration & Contract
3.1 Conclusion of the contract

A binding contract for participation in a training only comes into effect when the registration is confirmed by Magic Agile. The customer is bound to their registration for 14 days from the date of receipt of their registration. If the customer does not receive confirmation from Magic Agile within that time, the customer will not be bound by their registration.

3.2 Number of participants

Event confirmation by Magic Agile is subject to the condition that the minimum number of 4 participants is reached. The maximum number of participants is limited for didactic reasons to ensure learning success. Registrations will be considered in the order of their arrival.

4. Cancellations by the customer and substitute participants
4.1 Cancellation

The customer can cancel the participation in the training free of charge up to 2 calendar weeks before the training starts. For cancellations up to 1 calendar week before the start of the training, a cancellation fee of 50% of the training price will be charged. For cancellations within 1 calendar week before the start of the training, 100% of the training price will be charged. Even in the case of complete or partial non-participation, 100% of the training price shall be charged.

4.2 Substitute participants

The customer is entitled to name a substitute participant at any time.

5 Changes/Postponements/Cancellations by Magic Agile
5.1 Training contents

Magic Agile is entitled to modify the training content to a reasonable extent that will still ensure stated learning objectives and outcomes are met.

5.2 Changes of date / location

Should a training not be able to take place due to illness or accident of the trainer, force majeure or other unforeseeable events, there is no claim to the training. In such cases Magic Agile is not liable for travel and accommodation costs, loss of working hours or for indirect damage, in particular loss of profit or third party claims. Magic Agile reserves the right to cancel a training if the number of participants is too low. In this case, the customer may choose between attending the training on another date or receiving a refund of the full training price. The customer is not entitled to any further claims.

6. Prices/Payment conditions

The invoice will be issued before the training starts. The price shown in the training description applies. The invoice amount is payable in full directly after receipt of the invoice, by the due date stated on the invoice, and in any case before the start of the training. Any discounts granted can only be granted if the invoice amount is received in full within the specified payment period, but no later than the start of the training course. Magic Agile reserves the right to exclude customers who have not fulfilled their payment obligations from training courses.

7. Proprietary rights

The documents handed over as part of the training course are intended solely for the personal use of the training participant and remain the property of Magic Agile until the training fee has been paid in full. It is not permitted to use the documents for the instruction of third parties, to pass them on to third parties or to copy them. In addition, the terms of use stated in the documents apply.

The customer agrees that Magic Agile may use the client's name and company as a reference.

8. Data protection

Magic Agile stores the information provided by the customer during registration solely for the purpose of processing their participation in the training and to be able to contact customers and participants before, during and after the training. If participation in the training is certified by a third party, the customer agrees to the disclosure of the e-mail address, first and last name, country of residence and data about the training attended. Everything else is regulated by our privacy policy.

9. Disclaimer

Magic Agile accepts no responsibility for accidents that occur on the customer's way to and from the training location. In the case of training rooms in a building, the customer's route ends/begins at the entrance to the training rooms.

10. Miscellaneous

Any additional or deviating agreements must be made in writing. This also applies to the waiver of the written form requirement. Should one of these provisions be or become invalid, the validity of the remaining provisions shall not be affected.

If the client is a merchant, the place of jurisdiction is the registered office of Magic Agile.
